Kenya's Court of Appeal temporarily lifts High Court orders blocking Kenya–US health deal

Kenya's Court of Appeal on Wednesday temporarily lifted High Court orders that had suspended a Kenya–United States health cooperation agreement, allowing implementation to continue pending a full appeal.

The ruling means the government can proceed with the health framework, which is part of a broader US led global health financing initiative signed with several partner countries.

The framework, signed in December 2025, is part of a broader US health financing model that has also been adopted by other countries, including Rwanda and Uganda, according to court documents and prior filings.

The High Court had previously halted implementation following a petition by the Consumers Federation of Kenya (COFEK), which argued that the agreement raised concerns over data protection, public participation and constitutional compliance.

The Court of Appeal said the High Court orders would remain suspended until the appeal is fully heard and determined.

In its submissions, the government argued that the suspension had disrupted health programs and risked delaying access to external financing for immunization, disease control and digital health systems.

The case will proceed to full hearing, where the legality of the framework will be determined.
